Shipping Policy for Bespoke Design Products
1. Introduction
We are dedicated to delivering high-quality bespoke design products tailored to your specifications. This policy outlines our shipping procedures and what you can expect when ordering from us.
2. Despatch Times
Despatch times specified on the order confirmation are estimates only. The Company shall not be liable for any delays in transit or consequential losses to the Buyer or third parties once the Goods have been collected or despatched. The Buyer shall not be entitled to reject the Goods or withhold payment due to the Company’s failure to meet a delivery date.
3. Delays and Suspensions
The Company reserves the right to delay or suspend deliveries if the Buyer fails to observe payment terms or provide necessary technical and commercial information in time to meet the delivery date. Additionally, if required official or third-party consents are not obtained, delivery may be delayed.
4. Force Majeure
The Company may undertake to comply with a specific delivery date in writing. However, any liability for delays caused by force majeure, legislation, decrees, or orders of any government or country is excluded. In such cases, the Company will notify the Buyer, and its obligations under the contract will be suspended.
5. Instalment Deliveries
The Company reserves the right to deliver Goods in one or more instalments. Non-delivery of one instalment does not entitle the Buyer to refuse the remaining instalments.
6. Quantity Variations
The Company reserves the right to deliver up to 10% more or less than the quantity or weight ordered. The price payable by the Buyer will be adjusted based on the actual quantity or weight delivered.
7. Failure to Take Delivery
If the Buyer refuses or fails to take delivery of the Goods as per the contract, the Company will store the Goods at the Buyer’s cost and risk for two weeks. During this period, the Goods will be available for collection. If the Buyer fails to collect the Goods within this period, the Company may either demand immediate performance of the agreement or terminate the agreement and claim damages.
8. Compensation for Late or Non-Delivery
If the Buyer succeeds in a compensation claim for late or non-delivery, damages shall be limited to 1.5% of the invoice price for each full week of delay, with a maximum of 5% of the value of the relevant delivery.
9. Carrier Freight and Insurance
Carrier freight and insurance costs are the responsibility of the Buyer. The Company is not liable for these costs but may agree to submit a claim on behalf of the Buyer.
